  • Damages due to reliance on predictions or insights

9. No Warranty

All services are provided “as-is” and “as-available.” We make no guarantees regarding:

  • Accuracy or completeness of tools, data, or insights

  • Availability or uptime of the website or reports

  • Future value of any real estate investment

  • Security of third-party transactions

10. Jurisdiction & Dispute Resolution

VerifyState operates under Indian laws.

In case of a dispute, you agree to:

  • First attempt informal resolution through communication.

15. Platform Availability and Downtime

We strive for 99.9% uptime, but VerifyState may become temporarily unavailable due to scheduled maintenance, system upgrades, technical failures, or force majeure events (natural disasters, cyberattacks, etc.).

We do not guarantee uninterrupted access. Downtime will not qualify for compensation of any form.

16. Data Privacy and User Consent

By using our platform, you consent to the collection, storage, processing, and use of your data under our Privacy Policy.

25. Content Updates and Information Lifecycle

We are not liable for:

  • Archived or removed property details

Users should always fetch fresh data before making any decision.

26. Tax Implications

We do not provide tax advisory services.

Users must consult their CA or tax advisor for:

  • Capital gains

  • Stamp duty

  • TDS

  • GST applicability on real estate deals

27. User Account Security

You are responsible for:

  • Keeping your account secure

  • Not sharing login credentials

  • Updating your password regularly

We are not responsible for unauthorized use if your account is compromised due to negligence.

28. Use of VerifyState by Businesses

If you are an organization (e.g., brokerage firm, developer, lender):

  • You must register for a commercial or enterprise account if applicable

  • Misuse of personal accounts for commercial gain may lead to account restrictions

29. Suspension & Termination

We reserve the right to suspend or terminate any user account:

  • That violates our terms, policies, or legal obligations

  • That engages in fraudulent, abusive, or manipulative behavior

  • Without refund or compensation in case of violation

30. Limitation of Platform Liability

To the maximum extent allowed by law, VerifyState, its owners, affiliates, developers, and partners shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from:

  • Platform usage or data reliance

  • Business losses or investment decisions

  • Platform errors, bugs, downtime, or cyberattacks

31. Indemnification by User

You agree to indemnify, defend, and hold harmless VerifyState and its team from any claims, losses, damages, liabilities, legal fees, or costs arising out of:

  • Violation of our terms

  • Misuse of data or tools

  • Infringement of any rights or laws while using our platform

32. Data Scraping, Copying, and Misuse Ban

All tools, datasets, models, and interfaces on VerifyState are protected IP.

Strictly prohibited:

  • Data scraping or crawling

  • Cloning of business model, reports, or UX

  • Using our output in other products or services without permission

33. Right to Ban, Block, or Remove Accounts

VerifyState reserves absolute authority to:

  • Suspend or terminate any user account

  • Block access due to abuse, fraud, or policy violations

  • Delete harmful, misleading, or spammy content posted by users

34. No Guarantee of Continuous Access

We do not guarantee uninterrupted platform access. Downtime, maintenance, or emergency shutdowns may occur.

No user shall claim:

  • Refunds, damages, or losses

  • Reimbursement for missed opportunities

35. Disclaiming Legal Responsibility for Third-Party Fraud

We are not responsible for fraud, deception, or loss caused by:

  • Brokers, developers, or sellers listed on the platform

  • External links or agents outside our system

  • Users transacting based on unverified listings

36. Platform Modification Rights

37. Intellectual Property Ownership

All content, reports, code, UX designs, maps, and data models on VerifyState are exclusive IP of the platform.

Unauthorized use, copying, reselling, or redistribution will:

  • Lead to permanent account suspension

  • Trigger legal action and monetary penalties

38. By accessing, browsing, using, registering, subscribing to, or interacting with VerifyState in any manner—whether as a guest, registered user, customer, contributor, developer, affiliate, or third party—you explicitly, irrevocably, and unconditionally agree to the following terms without limitation:

  1. Total Waiver of Liability:

    You fully waive and relinquish all rights to hold VerifyState, including but not limited to its founders, owners, directors, shareholders, employees, engineers, advisors, legal consultants, data providers, hosting partners, vendors, contractors, subsidiaries, and affiliates, liable for any damages—direct or indirect, actual or perceived, punitive, consequential, incidental, emotional, financial, reputational, or otherwise—arising from or related to your use, misuse, or inability to use this platform.

  2. No Legal Recourse Across All Jurisdictions:

    You agree that no legal action, complaint, arbitration, mediation, consumer claim, or regulatory dispute can be brought against any stakeholder of VerifyState under any legal framework or cause of action, including but not limited to contract law, tort law, equity, consumer law, negligence, statutory rights, fiduciary duty, intellectual property law, or international law, unless explicitly permitted under this disclaimer.

  3. Risk-Bearing Use of Platform:

    All tools, models, calculators, data sets, reports, market analyses, insights, investment indicators, property listings, verification tools, forecasts, AI-generated content, and research published or presented on the platform are strictly informational and non-binding.

    They are subject to delays, errors, third-party inaccuracies, market unpredictability, and technological limitations. No warranties—express, implied, or statutory—are provided.

  4. Absolute Indemnification:

    You agree to fully indemnify, defend, and hold harmless VerifyState and all of its stakeholders against any legal claim, regulatory inquiry, loss, cost, damage, or liability—past, present, or future—arising from your use or reliance on the platform, even if such claims arise due to third-party actions, cyber incidents, AI misinterpretations, or market volatility.

  5. No Advisor-Client Relationship:

    The use of VerifyState does not establish any form of fiduciary, agency, advisory, brokerage, or client relationship between you and the platform. The platform is not a registered investment advisor, real estate agent, broker, or legal entity providing transactional services.

  6. Precedence of This Clause:

    This clause supersedes all prior and conflicting policies, terms, and communications, and shall take precedence in the event of ambiguity, contradiction, or dispute.

  7. Zero-Tolerance Binding Condition:

    If you disagree with any part of this clause or the VerifyState policies, you must immediately discontinue all use. Continued use of any part of the platform constitutes final, irrevocable, and legally binding acceptance of this Ultimate Legal Shield.
